The Federal Trade Commission's updated Safeguards Rule comes into effect on December 6th 2022 and imposes a series of prescriptive “administrative, technical, and physical safeguards” dealers must set in place to both prevent Nonpublic Personal Information (NPI, or PI) from being disclosed to unauthorized third parties and prove they are handling PI properly through a detailed audit trail.

As stressed during the NADA legislative update at the 2022 NADC Annual Member Conference, dealerships should not forget that the vehicles on their lots capture, process, and store indefinitely (unless action is taken) growing amounts of PI. This workshop is led by Andrea Amico, founder and CEO of Privacy4Cars and recognized thought leader on the topic of vehicle privacy protections. Attendees can find valuable insights to design, implement, and augment their own compliance program to include PI stored in vehicles they own, including trades, lease returns, loaners and extended test drives, etc.  

Participants will be provided with early access to a whitepaper on the topic authored by renowned compliance expert Randy Henrick (Ignite Consulting Partners), who will join Andrea Amico in a panel discussion and Q&A with the audience. Topics that will be discussed include:

  1. What data vehicle capture and how it falls under the definition of PI
  2. What Privacy4Cars' research shows on how frequently data is breached and how consumer sentiment is evolving on the topic of privacy in vehicles
  3. What theory of liability and precedents exist at the state and federal level
  4. How the prescriptive list of actions provided by the FTC specifically apply to PI in vehicles, and
  5. What practical steps dealerships can take to reduce their vehicle PI safeguard risk and turn it into a source of competitive advantage
